Terms of Use

These Terms of Use constitute an agreement under which the Tibiara Administration (also referred to as the “Administration,” “we,” “us,” or “our”) grants access to an account for playing the online role-playing game “Tibiara” (the “Game”).

By creating an account, logging into the Game, logging onto the Website, downloading the Client Software, or using any of our Services, you accept all the conditions in this agreement, including its components (“Game Rules,” “Privacy Policy”). By proceeding with any of these actions, you also confirm that you are of legal age in your country or have received permission from your legal guardian to play this Game.

This agreement uses the following definitions: “User” (also the “Player,” “they,” “their”) refers to any individual granted access to an account to play the Game or utilizing our other Services under this agreement; “Services” refers to all services we provide, whether explicitly mentioned or not; “Website” means the internet domain available at tibiara.com (and all related pages); “Client Software” (also referred to as the “Client” or “Software”) refers to the official software we provide, which is used to log into the Game. In the Game Rules, the Administration may also be referred to as “Staff” or “Gamemasters.”

Warranty

Using the Software, the Website, or any of our Services is at the User’s own risk. We provide all Services on an “as is,” “as available” basis and disclaim any and all warranties. While we endeavor to provide stable and error-free Services, we cannot guarantee uninterrupted access or the absence of defects. We also disclaim liability for any damages arising from outages or software issues. We reserve the right to suspend, shut down (temporarily or permanently), or modify the Game and any other Services at any time without incurring responsibility for any loss, including—but not limited to—direct or indirect damages or loss of profit, business interruption, or loss of information.

Property

All characters, virtual items, and other game-related data remain our property. We reserve the right to modify or delete them at our discretion. By granting you access, we permit you to use these assets under this agreement strictly for participating in the Game. Consequently, phrases like “your character” or “your item” do not denote ownership but indicate the usage rights we provide under this agreement. We can revoke these rights at any time, particularly in cases described in the Game Rules.

Moreover, Users receive no sub-license or authorization to trade accounts, characters, or items (aside from in-game trading of virtual commodities). Any such transfer or trade constitutes a violation of this agreement and may be regarded as copyright infringement. We will not mediate disputes arising from account, character, or item sharing/trading, nor can we be held accountable for any losses resulting from such situations (including account theft). Users are responsible for safeguarding their account and the associated email address and should not reveal their login credentials to others.

Fees

Tibiara is free to play. However, part of its content is restricted to Users with a premium status. Premium status is granted to an account for a limited time when a premium token is activated. Once activated, the token adds 30 days of premium time, irrespective of your current remaining quota. Purchasing tokens is entirely optional, and payments must be made in advance. Payments are refundable only if the purchased tokens have not yet been activated or traded by the User. Refund requests should be sent to [email protected] and will be processed within three business days. We reserve the right to modify fees and billing methods at any time, but any changes will not affect past purchases. Current fees are listed on the Website under the Premium section. Any premium time lost due to an account ban is non-refundable.

To safeguard our interests and combat fraudulent payments (e.g., payments using compromised credit cards), we reserve the right to reject token purchases for accounts exhibiting suspicious activity. We also reserve the right to cancel past suspicious transactions, refunding any associated amounts immediately. If one or more payments are charged back or a dispute procedure is initiated, we may block the purchaser’s accounts until the matter is resolved.

Game Rules

Tibiara fosters competition and collaboration among Players worldwide. To ensure fair and enjoyable gameplay for everyone, we have created a set of additional guidelines, referred to as the “Game Rules” (also the “Rules”). These Game Rules are posted on the Website. Players must follow these Rules whenever they access the Game, Website, or any other Service. We reserve the right to address inappropriate behavior by temporarily or permanently suspending access to the Game or other Services (“banishment”) as outlined in the Rules. In such cases, the sanctioned Player will be informed about the exact rule violation.

If the ban results from breaching rule 3c), 3d), or 3f) (“Cheating”), we may withhold detailed information on when and how the violation occurred if disclosing it could assist the offender in refining future cheating methods. We use advanced detection methods to ensure fair play, and preventing reverse-engineering of these methods is crucial. In such scenarios, as well as in other extreme violations, the ban may extend to other accounts accessed by the same User.

User’s Content

Users bear full responsibility for the content they submit to our Services (e.g., forum posts). Users must ensure that any submitted content complies with this agreement, does not break any law, and is not an infringement of a third party’s copyright. We are not responsible if sensitive information is intentionally or unintentionally disclosed by the User (e.g., in a public post).

Content submitted by Users does not reflect the Administration’s views, nor does it receive any endorsement or verification from us. We reserve the right to edit or remove any user-generated content without prior notice, particularly if it violates this agreement, the law, or is found objectionable. We also reserve the right to adopt ideas submitted on the Proposals board for our own benefit without limitation; by submitting such ideas, the User relinquishes any claims to them.

Privacy Policy

We fully respect the privacy rights of all Users. We acknowledge the significance of these rights and are committed to protecting them. To this end, we have instituted appropriate procedures to keep all shared information secure. We limit the amount and type of personal data we collect and process strictly to what is necessary for using and maintaining our Services. Please refer to our Privacy Policy for a detailed description of the personal data we collect and how it is used.

Final Provisions

We reserve the right to block certain IP addresses from accessing our Services to preempt unwanted—or specifically illegal—activities (e.g., DDoS attacks, hacking attempts, or fraudulent payments).

We may revise this agreement at any time. Any changes will be announced on the Website and take effect seven days after the announcement. Users should review the agreement regularly to remain informed of any updates. This agreement is governed by, and interpreted in accordance with, Polish law.
